Meghalaya Honeymoon Murder Case: Sonam Raghuvanshi को Bail, Court ने कहा Arrest Grounds Clear नहीं

Meghalaya honeymoon murder case में बड़ा अपडेट आया है। Shillong court ने आरोपी Sonam Raghuvanshi को bail दे दी है। ये वही केस है जिसमें Sonam पर अपने पति Raja Raghuvanshi को honeymoon के दौरान मरवाने का आरोप है।

क्यों मिली Sonam Raghuvanshi को Bail?

Court ने bail देने की जो वजह बताई, वो काफी interesting है। Hindustan Times के मुताबिक, court ने कहा कि Sonam को arrest करते वक्त उसे grounds of arrest effectively नहीं बताए गए। यानी पुलिस ने ये साफ नहीं किया कि उसे क्यों गिरफ्तार किया जा रहा है।

NDTV की रिपोर्ट में एक और दिलचस्प बात सामने आई। "Intimation of Grounds of Arrest" में BNS का वो section लिखा गया जो मौजूद ही नहीं है। Section 403(1) of BNS — ये section कानून में है ही नहीं। ये एक clerical error था जिसने Sonam की bail में मदद की।

क्या है पूरा मामला?

Sonam Raghuvanshi पर आरोप है कि उसने अपने पति Raja Raghuvanshi की हत्या की साजिश रची। ये सब तब हुआ जब दोनों Meghalaya में honeymoon मना रहे थे। Indian Express ने बताया कि court ने ये भी कहा कि arrest के समय grounds को "not effectively communicated" किया गया।

India Today की रिपोर्ट के मुताबिक, court ने इस clerical error को गंभीरता से लिया। एक non-existent section का mention होना ये दिखाता है कि arrest की प्रक्रिया में लापरवाही हुई।

क्या कहता है कानून?

Live Law के अनुसार, किसी भी व्यक्ति को arrest करते समय उसे grounds of arrest बताना constitutionally mandatory है। अगर ऐसा नहीं होता, तो वो व्यक्ति bail का हकदार हो जाता है। यही वजह है कि court ने Sonam को bail दी।

Hamaari Baat: Process की गलती से मिली राहत

हमारी नज़र में ये मामला सिर्फ एक हत्या के केस का नहीं है। ये दिखाता है कि कानूनी प्रक्रिया में छोटी सी गलती भी बड़ा असर डाल सकती है। एक clerical error — एक non-existent section — ने आरोपी को bail दिला दी।

लेकिन याद रखना, bail का मतलब बरी होना नहीं है। Sonam को सिर्फ procedural ground पर bail मिली है। केस की सुनवाई आगे भी चलेगी। हालांकि, ये एक सबक है police और investigating agencies के लिए — arrest की प्रक्रिया में कोई चूक मत करो, वरना आरोपी को फायदा मिल सकता है।
